1. There are two ways for Chinese applicants to apply for patents from the Netherlands: Paris Convention and direct application.
 
2. Examined by: Netherlands Patent Office, RVO, affiliated to Netherlands Enterprise Office.
 
3. Application submission: You can submit the application at the patent administration department, or by direct mail or e-mail.
 
4. Formal examination: RVO conducts formal examination on patent application documents.
 
5. Search report: The patent applicant must submit a novelty search request within 13 months from the application date, and will receive the search report within 9 months after the request. If the patent application has been published at this time, the search report will also be published; According to the results of the search report, the applicant has 2 months to modify or propose a division; The search report contains a written opinion.
 
6. Publication, examination and authorization: If the examination has been completed when the Dutch patent application is published for 18 months, the patent application will be authorized; If the time for filing the request for actual examination is late, the authorization will be delayed, and the applicant will no longer have the opportunity to modify the patent application:
 
Step 1
 
The submission materials of Dutch invention patent application include: patent application form and patent specification, which are composed of title, invention description (mandatory), claims (mandatory), drawings (optional) and abstract.
 
Step 2
 
Patent applicants can submit their own applications or authorize professional representatives. Applications can be submitted in person, by fax, online or by mail. Dutch is the official application language. As of June 5, 2008, the description and abstract can be submitted in English. However, the claims must be in Dutch (mandatory).
 
Step 3
 
The novelty search must be requested within 13 months after the patent application. This search can be carried out by the Dutch Patent Office or EPO.
 
Step 4
 
The Dutch patent will be granted 18 months after the date of application or priority.
 
Step 5
 
From the fourth year, you must pay a fee to maintain the patent.
