How to apply for Dutch invention patent
Application route
Generally, there are two ways: one is to apply directly to the Netherlands for a patent, and the other is to apply for a designated Dutch patent through EPO, but not through PCT.
Application process
Submit application → formal examination, issue search report → patent is granted actively, issue authorization notice → issue license.
Search review
The Dutch invention patent application can be authorized without substantive examination, but it needs to submit a novelty search request within 13 months from the date of application.
Protection period
It can be renewed indefinitely for 20 years from the date of application. Like Dutch trademarks, Dutch patents can enjoy the same rights and protection in Belgium, the Netherlands and the Netherlands.
